1. Who you are contracting with
This website is operated by Access Transit Express, a company registered in Indonesia ("we", "us", "our"). We are the merchant of record for every transaction made through this site: the contract for the services you book is with us, and it is our name that appears on your card statement as ACCESSTRANSITEXPRESS.
The services are performed in Thailand, by our Bangkok operation. You contract with the Indonesia entity and the Thailand operation delivers — that split is stated here, on every listing and at checkout so it is never a surprise.
"You" means the person making the booking. If you book for other people, you confirm that you have their authority to do so and that you accept these terms on their behalf, including the cancellation terms.
These Terms are a public offer. Together with the listing page for the service you choose, the Refund & Cancellation Policy, the Service Delivery Policy and the Privacy Notice, they set out the complete terms on which we sell. Completing a booking is acceptance of that offer in full, and forms a binding contract between you and us. Nothing said by a member of staff varies them unless we confirm it to you in writing.
2. Our role: organiser or agent
Every service sold on this site is performed in Thailand, while the contract is with our Indonesia entity. We contract for it in one of two capacities, and every listing states plainly which one applies to it, on the listing page itself and again on your voucher.
Where we act as organiser (principal)
This covers day trips, city and cultural tours, boat trips and charters, private transfers, airport fast-track and meet-and-assist, and nature and adventure experiences — the large majority of this site.
For these, we are the principal. The service is operated by us, or by a local supplier that we engage in our own name in Thailand. Your contract is with us and not with the driver, guide, captain, boat owner or airport handler. We are responsible for delivering the service as described, we select and supervise the supplier, and any claim arising from the service is made against us.
Where we act as agent
This covers admission tickets to third-party attractions — observation decks, stadiums, theatres, aquariums, gardens and similar venues.
For these, we act as the authorised sales agent of the venue or operator named on your voucher, and we collect payment on their behalf. The service itself is supplied by that venue under its own conditions of entry, which apply alongside these terms. We remain your single point of contact: we take the booking, issue the voucher, handle cancellations and refunds under our own refund policy, and deal with any problem on the day.
In both cases
- We are the merchant of record. The charge is made by us, the invoice is issued by us, and any refund is paid by us. Your card statement reads ACCESSTRANSITEXPRESS.
- You deal only with us. You never have to chase a Thai supplier directly, in Thai, in a different time zone.
- We do not act as an agent for you in dealings with third parties, and we are not a marketplace: we do not list inventory belonging to sellers we have no contract with.
- The cross-border structure changes nothing for you. Whichever capacity applies, your counterparty is the Indonesia entity named in section 1, and your remedy is against it.
We hold the licences and registrations required to trade in this capacity in Thailand; they are listed in section 1 above and on our about page as they are issued.
3. What we sell
We sell ground services in Thailand: guided tours and day trips, private and shared transfers, airport fast-track and meet-and-assist services, boat trips and charters, and admission tickets to third-party attractions.
Some services are performed by us directly; others are performed by carefully selected local operators under contract to us. In both cases we remain your contractual counterparty and you deal only with us. Where we sell an admission ticket to a third-party venue, the venue's own conditions of entry also apply, and we will tell you so on the listing.
Airport fast-track services are queue-management services arranged with the relevant airport authority. They do not, and cannot lawfully, exempt anyone from immigration, customs or aviation security processes. Immigration decisions rest entirely with Thai Immigration officers.
4. Making a booking
- Submitting the checkout form is a request, not a concluded contract. It reserves your places while we verify availability.
- We check availability with the operating supplier and confirm by email, normally within a few hours. If the service is unavailable we will offer you an alternative or decline the request, and you owe us nothing.
- A contract is formed when we send you a payment link and you complete payment. Your booking is confirmed when your voucher is issued.
- We may decline a booking where a supplier is full, where the request appears fraudulent, where the passenger details are incomplete or inconsistent, or where we reasonably believe we cannot deliver the service safely.
- Some services require accurate passenger names, passport details or flight numbers. National park manifests and airport passes are issued per name, and cannot be transferred at the pier or at the gate.
5. Prices, currency and taxes
All prices on this site are quoted and charged in Thai baht (THB), because that is the currency our Thailand suppliers invoice us in. Prices shown in other currencies are indicative conversions provided for guidance only; your card issuer performs the actual conversion at its own rate and may add a foreign transaction fee that we neither set nor receive.
Indonesian domestic payment rails — QRIS, virtual accounts and e-wallets — can carry only rupiah. If you choose one of those, the booking is converted to Indonesian rupiah and the exact rupiah amount is shown and confirmed to you before you authorise the payment.
Prices include the national park entrance fees, marine insurance, fuel surcharges and service charges that apply to the listing you are booking, and any tax due in Thailand on the service. Where a fee is not included, the listing says so explicitly under "not included".
We may change published prices at any time, but never after your booking is confirmed. A confirmed booking is at the price stated on your voucher.
6. Payment
Payment is taken in full at the time of booking, through a secure hosted payment page operated by our payment service provider. Card details are entered on that provider's page and are never entered on, transmitted through, or stored by this website. See our payment security statement for the detail.
We accept Visa, Mastercard, JCB, American Express and UnionPay; QRIS, virtual-account transfer and Indonesian e-wallets; and international bank transfer for larger bookings. 3-D Secure authentication applies to card payments. If your payment is declined by your issuer or flagged by fraud screening, your booking is not confirmed and we will contact you.
Payment links are valid for the period stated on the link, normally 24 hours. If a link expires we release the reservation and you will need to book again, subject to availability.
7. Vouchers and delivery
Services are delivered as an electronic voucher sent to the email address you gave at checkout, issued immediately on payment. Full detail of what is delivered and when is in our service delivery policy. There is no physical shipment and no shipping charge.
8. Changes and cancellations
Each listing states its own free-cancellation window — normally 24 or 48 hours before the start time — and that window is repeated on your voucher. The complete rules, including what happens when we cancel, are set out in the refund and cancellation policy, which forms part of these terms.
We may change the itinerary of a trip where safety, weather, tide, traffic, or a supplier's operational constraint requires it. Where a change is significant — a materially different itinerary, a change of more than four hours to the start time, or a change of destination — you may accept it, move to another date, or cancel for a full refund.
9. Your obligations
- Give accurate contact details, flight numbers and passenger names, and tell us promptly if they change.
- Be at the meeting point at the time stated on your voucher. Suppliers cannot wait indefinitely for one party, and a missed departure is treated as a no-show.
- Carry valid photographic identification. National parks and airport services require it.
- Tell us before booking about medical conditions, pregnancy, reduced mobility, or anything else that might affect your safety or your enjoyment of a trip. Every listing states its own restrictions.
- Follow the reasonable safety instructions of drivers, guides, captains and crew. They have final authority on their vehicle or vessel.
- Respect local law and custom, including temple dress codes and the prohibition on removing coral, shells and sand from marine parks.
We may refuse to carry, or may remove from a trip without refund, anyone whose behaviour puts the safety of others at risk, who is intoxicated, or who is abusive to staff or other guests.
10. Our obligations and limits
We will provide the services described on your voucher with reasonable skill and care, and will select suppliers with reasonable care. We will hold the price agreed and honour the cancellation terms stated.
We do not undertake that any particular sighting, weather condition, sea state or traffic condition will occur. Wildlife is wild. Waterfalls are seasonal. Views require visibility. Where a listing describes a natural phenomenon, that is a description of what is possible rather than a guarantee.
11. Events outside our control
Neither party is liable for failure to perform caused by events beyond reasonable control, including severe weather, marine department closures, natural disaster, epidemic, civil disturbance, strike, government action, airport or airspace closure, or the failure of public infrastructure.
Where such an event prevents us from delivering a service, you may move the booking to another date or receive a full refund. That is the case however close to departure the event occurs, and it applies even to bookings that are otherwise non-refundable.
12. Liability
We are liable for loss or damage you suffer that is a foreseeable result of our breach of these terms or of our failure to use reasonable care and skill. We are not liable for loss or damage that is not foreseeable.
Except in respect of death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation — none of which we seek to limit or exclude — our total liability arising from any booking is limited to the total amount you paid for that booking.
We are not liable for losses arising from your failure to attend at the stated time, from inaccurate information you gave us, or from a refusal of entry by an immigration officer, a venue or a carrier.
Passenger accident insurance is carried on our vehicles and vessels. It is not a substitute for travel insurance and we strongly recommend that you hold your own policy covering medical treatment, repatriation and cancellation.
13. Complaints
If something goes wrong on the day, tell your guide, driver or our operations desk immediately — most problems can be fixed while you are still in Thailand, and almost none can be fixed afterwards. For formal complaints, our procedure and timescales are set out in the disputes and chargebacks policy.
14. Data protection
We process your personal data in accordance with Indonesian Law No. 27 of 2022 on Personal Data Protection (UU PDP), the Thailand Personal Data Protection Act B.E. 2562 (2019) where data is handled by our Thai operation and suppliers, and the EU and UK General Data Protection Regulation where it applies. 15. Governing law
These terms are governed by the laws of the Republic of Indonesia, where the contracting entity is registered, and the Indonesian courts have jurisdiction. Our obligations are also subject to Indonesian consumer-protection law — Law No. 8 of 1999 on Consumer Protection — and to the rules on trading through electronic systems in Government Regulation No. 80 of 2019.
Nothing in this clause deprives you of protection you hold under the mandatory consumer law of your own country of residence, or of your right to bring proceedings there. Safety, licensing and operational conduct on the ground remain subject to Thailand law and to the authority of the local regulators, harbour masters and airport authorities, whatever this clause says.
If any provision of these terms is found unenforceable, the remaining provisions continue in force.
